Access to this Web site is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this Web site is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of this Website (www.gsa-metaltech.gr).

Our privacy policy, which sets out how we will use your information, can be found at this web page. By using this Web site, you consent to the processing described therein and warrant that all data provided by you is accurate.

We are committed to ensuring the security and protection of the personal information that we process, and to provide a compliant and consistent approach to data protection. We have always had a robust and effective data protection program in place which complies with existing law and abides by the data protection principles. However, we recognise our obligations in updating and expanding this program to meet the demands of the GDPR .

 

The EU General Data Protection Regulation (“GDPR”) 

Came into force across the European Union on 25th May 2018 and brought with it the most significant changes to data protection law in two decades.

We are dedicated to safeguarding the personal information under our remit and in developing a data protection regime that is effective, fit for purpose and demonstrates an understanding of, and appreciation for the new Regulation. Our preparation and objectives for GDPR compliance have been summarised in this statement and include the development and implementation of new data protection roles, policies, procedures, controls and measures to ensure maximum and ongoing compliance.

We have been carrying out a company-wide information audit to identify and assess what personal information we hold, where it comes from, how and why it is processed and if and to whom it is disclosed.

 

Policies & Procedures 

We are revising and implementing new data protection policies and procedures to meet the requirements and standards of the GDPR and any relevant data protection laws, including: 

 

Data Protection – our main policy and procedure document for data protection has been overhauled to meet the standards and requirements of the GDPR. Accountability and governance measures are in place to ensure that we understand and adequately disseminate and evidence our obligations and responsibilities; with a dedicated focus on privacy by design and the rights of individuals.

 

Data Retention & Erasure – we have updated our retention policy and schedule to ensure that we meet the ‘data minimisation’ and ‘storage limitation’ principles and that personal information is stored, archived and destroyed compliantly and ethically. We have dedicated erasure procedures in place to meet the new ‘Right to Erasure’ obligation and are aware of when this and other data subject’s rights apply; along with any exemptions, response timeframes and notification responsibilities.

 

Data Breaches – our breach procedures ensure that we have safeguards and measures in place to identify, assess, investigate and report any personal data breach at the earliest possible time. Our procedures are robust and have been disseminated to all employees, making them aware of the reporting lines and steps to follow. 

 

International Data Transfers & Third-Party Disclosures – where GSA Metaltech stores or transfers personal information outside the EU, we have robust procedures and safeguarding measures in place to secure, encrypt and maintain the integrity of the data. Our procedures include a continual review of the countries with sufficient adequacy decisions, as well as provisions for binding corporate rules; standard data protection clauses or approved codes of conduct for those countries without. We carry out strict due diligence checks with all recipients of personal data to assess and verify that they have appropriate safeguards in place to protect the information, ensure enforceable data subject rights and have effective legal remedies for data subjects where applicable.

 

Subject Access Request (SAR) – we have revised our SAR procedures to accommodate the revised 30-day timeframe for providing the requested information and for making this provision free of charge. Our new procedures detail how to verify the data subject, what steps to take for processing an access request, what exemptions apply and a suite of response templates to ensure that communications with data subjects are compliant, consistent and adequate.

 

Legal Basis for Processing - we are reviewing all processing activities to identify the legal basis for processing and ensuring that each basis is appropriate for the activity it relates to. Where applicable, we also maintain records of our processing activities, ensuring that our obligations under Article 30 of the GDPR and Schedule 1 of the Data Protection Bill are met.

 

Privacy Notice/Policy – We have revised our Privacy Notice to comply with the GDPR, ensuring that all individuals whose personal information we process have been informed of why we need it, how it is used, what their rights are, who the information is disclosed to and what safeguarding measures are in place to protect their information.

 

Obtaining Consent - we [have revised/are revising] our consent mechanisms for obtaining personal data, ensuring that individuals understand what they are providing, why and how we use it and giving clear, defined ways to consent to us processing their information. We have developed stringent processes for recording consent, making sure that we can evidence an affirmative opt-in, along with time and date records; and an easy to see and access way to withdraw consent at any time.

 

Direct Marketing - we [have revised/are revising] the wording and processes for direct marketing, including clear opt-in mechanisms for marketing subscriptions; a clear notice and method for opting out and providing unsubscribe features on all subsequent marketing materials.

 

Data Protection Impact Assessments (DPIA) – where we process personal information that is considered high risk, involves large scale processing or includes special category/criminal conviction data; we have developed stringent procedures and assessment templates for carrying out impact assessments that comply fully with the GDPR’s Article 35 requirements. We have implemented documentation processes that record each assessment, allow us to rate the risk posed by the processing activity and implement mitigating measures to reduce the risk posed to the data subject(s).

 

Data Subject Rights

In addition to the policies and procedures mentioned above that ensure individuals can enforce their data protection rights, we provide easy to access information via [our website, in the office, during induction etc] of an individual’s right to access any personal information that GSA Metaltech processes about them and to request information about: 

  •  What personal data we hold about them
  •  The purposes of the processing
  •  The categories of personal data concerned
  •  The recipients to whom the personal data has/will be disclosed
  •  How long we intend to store your personal data for
  • If we did not collect the data directly from them, information about the source
  • The right to have incomplete or inaccurate data about them corrected or completed and the process for requesting this
  • The right to request erasure of personal data (where applicable) or to restrict processing in accordance with data protection laws, as well as to object to any direct marketing from us and to be informed about any automated decision-making that we use
  • The right to lodge a complaint or seek judicial remedy and who to contact in such instances

 

Information Security & Technical and Organisational Measures

GSA Metaltech takes the privacy and security of individuals and their personal information very seriously and take every reasonable measure and precaution to protect and secure the personal data that we process. We have robust information security policies and procedures in place to protect personal information from unauthorised access, alteration, disclosure or destruction and have several layers of security measures, including: access controls, password policy, encryptions etc.

We have appointed a data privacy team to develop and implement our roadmap for complying with the new data protection Regulation. The team are responsible for promoting awareness of the GDPR across the organisation, assessing our GDPR readiness, identifying any gap areas and implementing the new policies, procedures and measures.

 

Prohibitions

You will not:

  1. commit or encourage a criminal offence;
  2. transmit or distribute a virus, trojan, worm, logic bomb or post any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene;
  3. hack into any aspect of the Service;
  4. cause annoyance to other users;
  5. infringe upon the rights of any other person's proprietary rights;
  6. corrupt data;
  7. send any unsolicited advertising or promotional material, commonly referred to as "spam";
  8. or attempt to affect the performance or functionality of any computer facilities of or accessed through this Web site.
  9. 01mechatronics.com e-shop will report any such breach to the relevant law enforcement authorities and disclose your identity to them.
  10. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Web site or to your downloading of any material posted on it, or on any website linked to it.

 

Intellectual Property and Confidentiality

Except where expressly stated to the contrary all persons (including their names and images), third party trade marks and images of third party products, services and/or locations featured on this Website are in no way associated, linked or affiliated with gsa-metaltech.gr and you should not rely on the existence of such a connection or affiliation. Any trade marks/names featured on this Web site are owned by the respective trade mark owners. Where a trade mark or brand name is referred to it is used solely to describe or identify the products and services and is in no way an assertion that such products or services are endorsed by or connected to GSA Metaltech and gsa-metaltech.gr website.

All technical documents enclosed within this website, such as product factsheets, datasheets, drawings, illustrations and the like, remain our exclusive property. Without our written consent, they may be neither copied nor communicated to a third party nor used for the construction of similar goods.

All information communicated to GSA Metaltech via its service will remain confidential unless otherwise agreed, for the duration of two (2) years from the date of receipt unless the information has already been in the public domain, or the information has been communicated to GSA Metaltech by a third party.

Other commercial exploitation of any kind, without prior written permission of an authorized officer of GSA Metaltech is strictly prohibited.

 

Usage

It is the Customer’s responsibility to ensure that the goods or services provided by GSA Metaltech will be used in accordance with national or international legislation and shall not violate any applicable laws or regulations.

Goods or services provided by GSA Metaltech are not to be used for military or surveillance infield operations. However customer may use goods or services provided by GSA Metaltech as technology demonstrators in the relevant areas.

 

Limitation of Liability

Under no circumstances whatsoever shall GSA Metaltech be liable to any person, firm or corporation for any special, indirect, or consequential damages, whether for breach of contract, negligence, misrepresentation, or otherwise, and whether resulting in lost profits, down time and related costs due to failure, loss of interest in money borrowed or invested, impairment of goods, or otherwise, in any way arising out of any transaction to which these standard terms apply.

Customer agrees to compensate and hold harmless GSA Metaltech from all claims, damages, liabilities, attorney's fees, and expenses arising from the ownership or use of the equipment, whether as a result of the manufacturer's or subsequent owner's or owners' defective manufacture, design, repair or failure to instruct or warn.

Our verbal or written advice is provided in good faith but without guarantee, specifically with respect to the application recommended.

The material displayed on this Web site is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary to the fullest extent permitted by law GSA Metaltech and the site www.gsa-metaltech.gr and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this Web site and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise.

GSA Metaltech shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the Services and Products and/or any page of this Web site.

Governing Law

This Agreement is governed by and construed under the laws of Greece and EU directives, which will apply if any controversy or claim regarding the equipment arises, provided that mandatory statutes do not stipulate otherwise. However, we also reserve the right to appeal to the competent court of the purchaser, as well as international courts.

The operation of gsa-metaltech.gr is governed by and construed in accordance with the laws of GREECE, e-Commerce Presidential Order No 131/2003 FEK A116 and  Law 2251/1994 FEK 191 and EU directives (31/2000/EU) and any disputes will be decided only by Greek courts.

If any of these Product Terms is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Product Terms which will continue to be valid and enforceable to the fullest extent permitted by law.

 

Other Terms

If any provision of this Agreement shall be unlawful, void or unenforceable for any reason, the other provisions (and any partially-enforceable provision) shall not be affected thereby and shall remain valid and enforceable to the maximum possible extent. You agree that this Agreement and any other agreements referenced herein may be assigned by GSA Metaltech, in our sole discretion, to a third party in the event of a merger or acquisition. This Terms of Use Agreement shall apply in addition to, and shall not be superseded by, any other written agreement between GSA Metaltech and the Customer.

 

Entire agreement

The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and gsa-metaltech.gr. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by GSA Metaltech Managament.
